Subscription Free Dial-up Accounts

Shetland Broadband LLP offers a subscription free dial-up service. Subscription free means that SBB make no charge for the service and all that the customer has to pay are any phone line costs incurred calls are made to a BT 0845 number. Your costs will be as listed by your phone line provider (BT charges as at 10/04/06 are £0.03 per minute daytime and £0.01 per minute. evenings and weekends inc. VAT). There are two types of service available:

The anonymous service does not require any registation and offers a basic dial-up connection to the internet.

  1. These Conditions of Use apply to SBB free dial-up account, irrespective of the place of issue. They may be revised at any time and without notice at the sole discretion of SBB. The use of a free dial-up account is taken as an agreement by the customer to adhere to the current conditions.
  2. A registered free dial-up account will be associated to the phone line given at the time of registration, only one free registered account (and therefore only one sub-domain) will be available per registered phone line. A registered dial-up account can be used on any phone line, however, a percentage of the monthly calls made with that account must be from the registered phone line.
    [Please note that from July 2008 no new registered free dial-up accounts will be created. Previously created accounts will continue without change.]
  3. Attempts by a customer to register additional free dial-up accounts for the purpose of gaining additional sub-domain licenses may result in termination of all the customer's accounts.
  4. A dial-up account can not be transferred to any other individual, body or business without the express permission of SBB.
  5. SBB will terminate an account if the customer obtains or attempts to obtain remuneration from any other body by re-selling the account as a product or part of any service.
  6. SBB may at it's discretion terminate an account at any time if the customer has broken any terms, conditions of the service or acceptable use policies which relate to either the use of a free dial-up account or any associated services.
  7. SBB will terminate a free dial-up account, without notice, if it is not used for a period of thirty consecutive days.
  8. Customers must monitor their mailbox provided for use with their registered accounts. SBB will use this mailbox as the delivery point for important information on the operation of the account. SBB will not be responsible for any loss of service or licence due to the customer not collecting such e-mails.
  9. You are required to adhere to these Conditions of Use. You are also required to adhere to the Acceptable Use Policies ("AUPs") that we publish from time to time for those components of the service that you use. If you breach them, we have the right at our sole discretion to suspend or terminate your account without notice or refund, to make an additional charge for the misuse, or to block access to the relevant component of the service.
  10. You may only access the machines and the specific ports which SBB have made available for public access. Any other use of SBB equipment is unauthorised and is a criminal offence under current UK Law.
  11. You are required to keep the contact details that you provided us up to date. We may send notices or other information to you at the address you gave us. We will not pass these details to other companies.
  12. We will use our reasonable endeavors to maintain all our services. You will not be eligible for any compensation because you cannot use the service or because of a failure, suspension or withdrawal of all or part of the service. We may change the service at any time. Whenever possible advance details of interruption of or changes to the service will be posted in an appropriate place (Web Site, Newsgroups Message of The Day etc).
  13. We shall not be liable for any consequential losses you may suffer.
  14. We are not responsible for any use you make of SBBs services, for any charges that you incur with any third party including telephone costs, nor for any software running on your host, except as documented within a separate written agreement or AUP. You indemnify SBB against the effects of any misuse or any claims resulting from that misuse.
  15. You will keep your passwords secret and will not disclose them to third parties for any purpose. You will notify us and change any password that you believe may have been compromised.
  16. You will not use the account for any illegal purpose.
  17. You will not sell on or share use of the service, or any part of it, with any other person except:
    • Members of your household at the same address.
    • Your employer or employees at the same address.
    • Any person permitted in the appropriate AUP.
    • Any person specifically agreed with us in writing.
  18. Where you use our service to reach networks and services not operated by us, you will abide by the AUPs, Terms and Conditions imposed by the operators of those networks and services.
  19. Any decision made by Calloo Internet in relation to the services provided, Conditions of Use and AUPs shall be final.
  20. These Conditions of Use and all other legal relationships between us shall be governed by and construed in accordance with the Scottish Law, and are subject to the exclusive jurisdiction of the Scottish courts.
  21. If any part of these Conditions of Use or any AUP shall be held to be invalid or unenforceable, this shall not affect the enforceability of any other provision of these Conditions of Use or AUPs.
 
Terminology used in these terms and conditions

"SBB" is an abbreviation of "Shetland Broadband LLP" (and also refers to Shetland Internet and Calloo Internet).

"SCBP" is an abbreviation of "Shetland Community Broadband Project".

"Account" means any package of services SBB provides to you (the customer), irrespective of whether they are paid for or free.

"AUP" refers to the Acceptable Use Policies of SBB.

"Customer" refers to an individual, organisation or business who is named as the recipient of a service or product provided by SBB, irrespective of whether they are paid for or free.

"Free" means that SBB do not currently make any charges to the customer for the service.

"licence" refers to the permission given to a customer by SBB to use a named sub-domain of a domain registered to SBB eg "shetland.co.uk" and "calloo.co.uk".

"licensee" refers to an individual, organisation or business to whom SBB has granted a licence.

"net abuse" means any breach of SBB's Acceptable Use Policies

"free web space" refers to web space given without charge by SBB to a customer for use with another SBB service (such as a dial-up account). The free web space is conditional and only available for the duration of that account.

"poster" means the author of the unacceptable article(s). This may or may not be the same as the customer, however, customers are ultimately responsible for all poster(s) using their accounts.
