Acceptable Use Policy for Free Web Space
  1. Commercial use of a customer's free web space is permitted for the promotion of your own/family business. Space may not be re-sold or sub-let to any other party in any form. This is an explicit exemption to the general Conditions of Use referring to selling on or sharing use of the service.
  2. The Conditions of Use for a Dial-Up Account relating to disclosure of your passwords apply. Specifically your passwords are your responsibility and must not be disclosed to any third party. Should you need to disclose your password for such purposes as allowing a third party service (web authors etc.) access to your space then you alone are entirely responsible for any actions they take.
  3. You must maintain an index page called "index.htm" or "index.html" in the root directory of your space.
  4. No user defined scripts (CGI; Perl; C; etc.) are permitted.
  5. Support is only available for uploading, downloading and viewing pages. No support will be given for HTML authoring or page design.
  6. No logs or any detail of who visited your site will be made available.
  7. You will be responsible for retaining copies of your own data. SBB will not keep backups of your pages. You may, however, download your own pages by FTP (using your logon details) for backup.
  8. SBB accepts no responsibility for loss of data, information in any form or other matters whatsoever which result from the use of this service.
  9. The customer will be responsible for the content of the web site, including obtaining the legal permission for any works they include and ensuring that the contents of these pages do not violate the Scottish Law.
  10. The customer will be held responsible for and accept responsibility for any defamatory, confidential, secret or other proprietary material available via the customer's web site.
  11. The customer must ensure that your "index.htm" or "index.html" file [the page displayed by default] does not contain any material liable to offend. A clearly readable warning page must be displayed before any legal adult material is displayed.
  12. Your homepages site may not be used to distribute or advertise any of the following:
    • Software for sending SPAM (bulk email, excessive news postings, etc.).
    • Software which is pirated, or passwords/registration details etc. for any commercial software (Warez).
    • Lists of email addresses except where all the addressees have given their explicit permission.
    • Any collection of personal data other than in accordance with the Data Protection Act and the Data Protection Principles.
    • Any media files (images, video, audio, mp3 etc.) for which you do not have the full permission of the copyright holder to use or distribute.
  13. The customer may not advertise their web site, or cause another person to advertise it, by techniques that would be classified as abuse if they were carried out from a SBB account. This includes, but is not limited to, bulk e-mailing and excessive news posting. Such action may be treated under the appropriate Acceptable Use Policy as if it had been done from the account, or as a violation of this Acceptable Use Policy or both.
  14. SBB shall not be held liable for any loss however occasioned as a result of the suspension, removal or unavailability of a customer's web site or material stored within it.
  15. If the customer does not keep the index file (index.htm or index.html) in the root directory of your Homepages space for a period of 6 weeks, the host name (www.subdomain.shetland.co.uk) may be withdrawn and your Homepages site may be deleted.
  16. If the account is barred for any reason access to the customer's web site may be suspended.
  17. When an account is closed by either the customer or SBB the web site will be deleted.
  18. Any limit on space is imposed by the process that accepts uploads. If you attempt to upload a file that exceeds the available free space the upload may fail. Should this check not operate for any reason, SBB reserve the right to request the customer to immediately remove enough files to bring the used web space below any limits.
  19. SBB reserve the right to remove any material from a web site on any SBB server at their sole discretion, without prior notice and without explanation.
  20. SBB reserve the right to suspend any or all web pages at any time, without prior notice and without explanation.
  21. SBB will require sites that they consider to show excessive use to be modified or be moved to a different server.
  22. SBB reserve the right to vary the definition of 'excessive use' at their sole discretion at any time without prior notice.
  23. SBB reserve the right to make a charge for any assessment of suspended sites.
  24. By uploading files to the SBB's server, the customer will be deemed to have agreed to and accepted the terms and conditions of use of the free web space service.
  25. The customer must not refer to your pages by any means other that the address "www.subdomain.shetland.co.uk" nor register the web pages anywhere using any form of URL except in the form as above. Specifically, you must not reference or cause the web pages to be referenced by dotted IP address (e.g. [62.172.189.66]). Requests made to web pages using dotted IP addresses or alternative names may not work.
  26. SBB reserve the right to vary the Conditions of Use and acceptable use policy for free web space at their sole discretion at any time and without prior notice.
  27. Any decision made by SBB in relation to this service shall be final.
 
Terminology used in these terms and conditions

"SBB" is an abbreviation of "Shetland Broadband LLP" (and also refers to Shetland Internet and Calloo Internet).

"SCBP" is an abbreviation of "Shetland Community Broadband Project".

"Account" means any package of services SBB provides to you (the customer), irrespective of whether they are paid for or free.

"AUP" refers to the Acceptable Use Policies of SBB.

"Customer" refers to an individual, organisation or business who is named as the recipient of a service or product provided by SBB, irrespective of whether they are paid for or free.

"Free" means that SBB do not currently make any charges to the customer for the service.

"licence" refers to the permission given to a customer by SBB to use a named sub-domain of a domain registered to SBB eg "shetland.co.uk" and "calloo.co.uk".

"licensee" refers to an individual, organisation or business to whom SBB has granted a licence.

"net abuse" means any breach of SBB's Acceptable Use Policies

"free web space" refers to web space given without charge by SBB to a customer for use with another SBB service (such as a dial-up account). The free web space is conditional and only available for the duration of that account.

"poster" means the author of the unacceptable article(s). This may or may not be the same as the customer, however, customers are ultimately responsible for all poster(s) using their accounts.
