Acceptable Use of a Shetland Broadband Account

Introduction
These Conditions of Use apply to all SBB broadband accounts, irrespective of the place of issue. They may be revised at any time and without notice at the sole discretion of SBB. Notification will be given prior to any changes.
Fair Use of Your Account
  1. Customers are required to adhere to these Conditions of Use. Customers are also required to adhere to the Acceptable Use Policies ("AUPs") that SBB publish from time to time for those components of the service that the customer uses. If a customer should breach them, SBB have the right at their sole discretion to suspend or terminate the account without notice or refund, to make an additional charge for the misuse, or to block access to the relevant component of the service.
  2. Customers must be 18 years or older to hold an account with SBB. If a customer is under 18 years old then the account must be ordered by a parent or guardian.
  3. Customers may cancel the service at any time, but please be aware that early closure of an account with a minimum contract period may require a financial settlement.
  4. Except where stated otherwise, customers must send us notice of termination in one of the following ways:
    • By post,
    • By fax,
    • By email from your SBB Account, or
    • By email from elsewhere or by telephone.
  5. Customers may only access the machines and the specific ports which SBB have made available for public access. Any other use of SBB equipment is unauthorised and is a criminal offence under current UK Law.
  6. SBB reserves the right to suspend or cancel any account at its sole discretion. If a subscription free dial-up account is not used during a period of thirty continuous days it will be deemed as being no longer in use, the account and any related services will terminated without notice.
  7. Customers are required to keep the contact details that you provided SBB up to date. SBB may send notices or other information to the customer's account e-mail address. SBB will not pass these details to other companies.
  8. SBB will use its reasonable endeavors to maintain all its services. Customers will not be eligible for any compensation because they cannot use the service or because of a failure, suspension or withdrawal of all or part of the service. SBB may change the service at any time. Whenever possible advance details of interruption of or changes to the service will be posted to the web site.
  9. Regardless of anything else in these Conditions of Use, SBB's liability shall not exceed the proportionate amount of the customer's subscription.
  10. SBB shall not be liable for any consequential losses a customer may suffer.
  11. SBB are not responsible for any use made by a customer of SBB's services, for any charges that the customer incurs with any third party including telephone costs, nor for any software running on a customer's host, except as documented within a separate written agreement or AUP. Customers indemnify SBB against the effects of any misuse or any claims resulting from that misuse.
  12. Customers will keep their passwords secret and will not disclose them to third parties for any purpose. Customers will notify SBB and change any password that they believe may have been compromised.
  13. Customers will not use the account for any illegal purposes including the copying and/or distribution of copyrighted material.
  14. Customers will not sell on or share use of the service, or any part of it, with any other person except:
    • Members of the customer's household at the same address,
    • A customer's employer or employees at the same address,
    • Any person permitted in the appropriate AUP, or where specifically agreed with SBB in writing.
  15. Where a customer uses SBB's service to reach networks and services not operated by SBB, the customer will abide by the AUPs, Terms and Conditions imposed by the operators of those networks and services.
  16. Users should also familiarise themselves with the following conditions:
  17. Any decision made by SBB in relation to the services provided, Conditions of Use and AUPs shall be final.
  18. These Conditions of Use and all other legal relationships between the customer and SBB shall be governed by and construed in accordance with the Scottish Law, and are subject to the exclusive jurisdiction of the Scottish courts.
  19. If any part of these Conditions of Use or any AUP shall be held to be invalid or unenforceable, this shall not affect the enforceability of any other provision of these Conditions of Use or AUPs.
Report Net Abuse

"SBB" is an abbreviation of "Shetland Broadband LLP" (and also refers to Shetland Internet and Calloo Internet).

"SCBP" is an abbreviation of "Shetland Community Broadband Project".

"Account" means any package of services SBB provides to you (the customer), irrespective of whether they are paid for or free.

"AUP" refers to the Acceptable Use Policies of SBB.

"Broadband" is the collective term for a method of connection to the internet such as ADSL, fibre, radio etc..

"Customer" refers to an individual, organisation or business who is named as the recipient of a service or product provided by SBB, irrespective of whether they are paid for or free.

"Free" means that SBB do not currently make any charges to the customer for the service.

"Licence" refers to the permission given to a customer by SBB to use a named sub-domain of a domain registered to SBB eg "shetland.co.uk" and "calloo.co.uk".

"Licensee" refers to an individual, organisation or business to whom SBB has granted a licence.

"Malware" is an umbrella term used to refer to a variety of forms of hostile or intrusive software, including computer viruses, worms, trojan horses, ransomware, spyware, adware, scareware, and other malicious programs. It can take the form of executable code, scripts, active content, and other software.

"Net abuse" means any breach of SBB's Acceptable Use Policies

"Free web space" refers to web space given without charge by SBB to a customer for use with another SBB service. The free web space is conditional and only available for the duration of that account.

"Poster" means the author of the unacceptable article(s). This may or may not be the same as the customer, however, customers are ultimately responsible for all poster(s) using their accounts.
